These Terms & Conditions ("Terms") govern your access to and use of the acqX website and any services provided by acqX. By using our website or engaging our services, you agree to these Terms. If you do not agree, please do not use our website or services.

1. About us & our services

acqX provides done-for-you client acquisition and marketing services, including lead generation, paid advertising, campaign management and related consulting, primarily for home renovation, floor-coating and trade businesses. The specific scope, deliverables, fees and duration of any engagement will be set out in a separate proposal or service agreement between you and acqX. Where there is any inconsistency between these Terms and a signed service agreement, the service agreement prevails.

2. Eligibility

You must be at least 18 years of age and have the authority to enter into a binding agreement on behalf of yourself or the business you represent in order to engage our services.

3. Enquiries & bookings

Submitting an enquiry or booking a strategy call does not create a binding engagement. It is an invitation for us to discuss whether our services are a suitable fit. A binding engagement is only formed once both parties agree to a proposal or service agreement.

4. Fees & payment

Fees for our services are as agreed in your proposal or service agreement. Unless stated otherwise, fees are payable in advance, are billed on a recurring monthly basis where applicable, and are exclusive of any third-party advertising spend (such as Meta or Google ad budgets), which you fund directly. Late or failed payments may result in the suspension or termination of services.

Our services may involve third-party platforms such as Meta (Facebook and Instagram), Google and CRM or scheduling tools. Your use of those platforms is subject to their own terms and policies. acqX does not control and is not responsible for the availability, decisions, account actions or policy changes of any third-party platform, including advertising account reviews, restrictions or suspensions imposed by those platforms.

7. No guarantee of results

While we apply our skill, experience and best efforts to deliver strong outcomes, marketing results depend on many factors outside our control - including your offer, pricing, capacity, market conditions and third-party platform behaviour. Accordingly, acqX does not guarantee any specific number of leads, bookings, sales, revenue or return on investment. Any examples, case studies or figures shown are illustrative and are not a promise of your results.

8. Intellectual property

All content on this website - including text, graphics, logos and design - is owned by or licensed to acqX and is protected by applicable laws. You may not copy, reproduce or reuse it without our prior written permission. Ownership of custom deliverables produced during an engagement is dealt with in the applicable service agreement. Client names and logos displayed on our website are used with permission to identify businesses we have worked with.

9. Confidentiality

Each party agrees to keep confidential any non-public information disclosed by the other in the course of an engagement, and to use it only for the purpose of that engagement, except where disclosure is required by law.

10. Disclaimer & limitation of liability

Our website and services are provided on an "as is" basis. To the maximum extent permitted by law, acqX excludes all warranties not expressly set out in these Terms. Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law that cannot lawfully be excluded. To the extent permitted by law, acqX's total liability arising out of or in connection with our services is limited to the amount of fees paid by you to acqX for the services in the three (3) months preceding the relevant claim, and acqX is not liable for any indirect, incidental or consequential loss, or loss of profit, revenue or opportunity.

11. Termination

Either party may terminate an engagement in accordance with the terms of the applicable service agreement. We may suspend or terminate your access to our services immediately if you breach these Terms, fail to pay, or engage in unlawful or harmful conduct.

12. Changes to these Terms

We may update these Terms from time to time. The latest version will always be published on this page with a revised "last updated" date. Your continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
